Cancellation of 2-yr service agreement

Our business is based in Africa even though our tech team is in California. We signed a 6-month lease for an office in Palo Alto in June 2015 and activated internet service with Comcast. We were not instructed that we were signing a 2-year agreement when we agreed to install internet service and it was not obvious at all on the service installation agreement. Since our lease was only 6 months long, it would not have made sense to agree to a 2-year service contract.

 

After our Palo Alto lease was up on December 31 2015 we decided to distribute the tech team and not have an office. We subsequently called Comcast to cancel service and were then made aware we had signed a 2-year agreement. The customer service reps thus refused cancellation on the exception that we could pay a cancellation fee of over $2500.

 

We no longer have an office anywhere in the US so we are not even using a competing service; it's not clear what Comcast is trying to protect. I've looked repeatedly at the service installation agreeement thinking that maybe we were just blind when we signed it. The 2-year term is hidden in small print on the right and easy to miss. The lack of clarity from the sales agent and the installation technician, in addition to the response from customer service, make it easy to assume the process is intentionally deceptive. 

 

Our immediate inclination is to just file in small claims court. Let us know if this can be resolved amicably. We feel it is unfair to charge us for a service we do not use, cannot use, and would not have signed up for had the Comcast sales process been transparent.

I'm sorry that your service term was not made more clear to you at the time of signing. It is listed on page one of your contract in the section listed Service Term (Months). 

 

Are you closing that location down or are you moving it to out of the country? If you're moving can you please send me a private message with your new address?

Hi - no.

 

As I mentioned in my post, we closed the location down on Dec 31 2015. We no longer have an office.

 

I'll ask again: please let me know if this can be resolved amicably.

I have a simular issue that I will be posting about, but I was never advised of a 1 year term even after asking for a 1 year. Luckily all of my communicstion was via email so I have record of me asking and the sales person saying he can do a 2 year as if there wasnt a 1 year. They first sent paperwork for a 3 year term
