Termination Fee Question

Hi all!

 

So, I want to terminate my contract with Comcast, because fiber optic internet is now available for my business location (it wasn't at the time we signed the agreement). I was shocked to see online that the early termination fee would be 75% of the remaining amount of the contract. This was never mentioned to me by the sales representative and is nowhere in the contract we "docusigned".

 

I do accept that it was in the long services agreement document I was probably told to read at some point, so I'm not here to complain on that front.

 

However, the service agreement isn't really clear on what this amount should actually be, especially because we upgraded the service a few months in.

 

My contract is for 24 months at $69.95 ($1,678.80).  I paid 7 months at that rate ($489.65), then ugraded to the faster service, and paid 9 months at $109.95 ($989.55). In other words, I've paid $1,479.20 of a $1,678.80 contract, leaving a remaining balance of $199.60.  Shouldn't my early termination rate therefore be 75% of $199.60?  

 

Here's the part in question:

 

  • Termination Charges with respect to each terminated Service Order shall equal, in addition to all amounts payable by Customer in accordance with Section 5.3, seventy-five percent (75%) of the remaining monthly fees that would have been payable by Customer under the Service Order if the Services described in the Service Order had been provided until the end of the Service Term.

 

By the calendar year, therefore, I have 8 months left on my 24-month contract, but due to the upgraded service, I've actually paid 21 months worth of my signed 24 month agreement. The line "shall equal...75% of the remaining monthly fees that would have been payable" to us should logically be read as "75% of the remaining amount committed to in the contract". This is how it works in other industries, including my company's own service agreement.

 

Incidentally, I've had no problems with Comcast and it has served us well. But with 1 gig (1,000 up/1,000 down) fiber optic internet now available at my office location for a comparable price, I don't want to have to wait until December to make this business upgrade.
