Disconnection of Service - Unfair Charges
I have been a customer since December 2013 and sigbned an agreement for the terms of my service to be until December of 2015. It states in my contract that the term is only for 24 months and that Comcast can charge me extra only if I violate this. I have been a good customer and paid on time and have fullfilled my part of the agreement.
As stated in the terms and agreement which there is a link to but not direct in the contract, the Service Term: The duration of time (commencing on the Service Commencement Date) for which Services are ordered, as specified in a Service Order.
And as also state in the contract:
Termination Charges: Except as otherwise provided herein, charges that may be imposed by Comcast if, prior to the end of the applicable Service Term (a) Comcast terminates Services for cause or (b) Customer terminates any Service without cause. Termination Charges with respect to each Service terminated during the initial Service Term shall equal, in addition to all amounts payable by Customer in accordance with Section 5.3, seventy-five percent (75%) of the remaining monthly fees that would have been payable by Customer under the applicable Service Order if the terminated Service(s) had been provided until the end of the initial Service Term, and one hundred percent (100%) of any amount paid by Comcast in connection with Custom Installation, as that term is defined in Section 2.7, for the Services provided by Comcast under such Service Order.
I am outside the Service Term as it ended in December of 2015. I have the right to terminate without any extra fees according to this. However, when I call in they say I have to pay for 60 more days which is ridiculous and not right.
The only place hidden online somewhere with some URL to it states:
Termination for Convenience. Notwithstanding any other term or provision in this Agreement, Customer shall have the right to terminate a Service Order or this Agreement, in whole or part, at any time during the Service Term upon sixty (60) days prior notice to Comcast, and subject to payment to Comcast of all outstanding amounts due for the Services, any and all applicable Termination Charges, and the return of any and all Comcast Equipment. Such termination shall be effective sixty (60) days after Comcast’s receipt of the termination notice.
Note as stated this is for the Service Term. I am clearly outside my service term.
I have been a good customer and fulfilled my service agreements. Please cancel my term immediately and let this be notification for this. I do not wish to be unfairly charged and it is wrong to be charged for 2 months for something that is outside the Service Term but also something I am not using or do not need.
